BUCKHANNON – A Tallmansville man was arrested for allegedly threatening someone with a baseball bat.

Roger Gooden, 37, of Tallmansville, was arrested for domestic assault third offense last week.

According to the criminal complaint in the Upshur County Magistrate Clerk’s Office, on Feb. 22, 2024, at approximately 8:40 a.m., trooper C.C. Jones with the Buckhannon detachment of the West Virginia State Police responded to Catawba Street in reference to a domestic situation.

“While on scene speaking with the victim … she advised that Roger Gooden did have a baseball bat in his hand while standing next to her and told her that he would take the baseball bat across your head, if you’re talking to anyone,” the complaint states.

The victim also said that “Gooden told her he would cut her face and that she believed he would commit the stated acts,” according to the complaint.

Officers located a baseball bat inside the residence, the complaint notes.

Gooden was convicted of domestic battery on Nov. 20, 2019, and Sept. 14, 2020, making this a third offense domestic assault, according to the complaint.

Bail was set at $10,000 cash or surety by Upshur County Magistrate Mark Davis.

The potential penalty for domestic assault third offense is confinement in a state correctional facility for not less than one nor more than five years, a fine of not more than $2,500, or both.
