Murder suspect among 48 people indicted by Upshur County grand jury

BUCKHANNON – The man alleged to have killed his father by partially decapitating him was one of 48 people indicted in Upshur County Circuit Court Tuesday.

Timothy Allen McWilliams, 65, of Buckhannon, was indicted on one count of murder, a felony, for allegedly killing his father, Leo McWilliams, during an altercation at their home, 449 Victoria St., on March 8, 2018. McWilliams has been held without bond in the Tygart Valley Regional Jail since March 2018.

During a Dec. 4, 2018 hearing, McWilliams’ attorney, Dennis Willett asked that bond be set for his client, a motion that 26th Judicial Circuit Court Judge Kurt Hall ultimately denied.

Hall said although he didn’t believe McWilliams was a flight risk, he believed he could potentially threaten the safety of his family, with whom McWilliams planned to live should he make bail.

Following the December hearing, Willett said he planned to reintroduce a motion to set bond at a later point in time, possibly after McWilliams’ indictment.

The grand jury handed down 54 true bills Tuesday, indicting a total of 48 individuals including McWilliams.

The following individuals were indicted Monday, Jan. 14, and Tuesday, Jan. 15:

-Jessica Nicole Snider-Sears, 37, of French Creek, was indicted on one count of shoplifting, third or subsequent offense, a felony.

-Jaquan Marquis Brock, 21, of Charleston, W.Va., was indicted on one count of possession with intent to deliver marijuana, a felony.

-Howard Joseph Landers II, 28, of Weston, was indicted on one count of malicious wounding, a felony.

-Nathan Mark Lewis, 32, of Belington, was indicted on driving while license revoked for DUI, third or subsequent offense, a felony.

-Ibrahim Sakho, 19, of Washington, D.C., was indicted one on count of conspiracy, a felony, and one count of delivery of a controlled substance within 1,000 feet of a school, a felony.

-John Ryan Henson, 23, of Elkins, was indicted on two counts of conspiracy, a felony, and one count of possession with intent to deliver marijuana, a felony.

-John Franklin Arbogast, 49, of Buckhannon, was indicted on one count of burglary, a felony, and one count of grand larceny, a felony. Arbogast was also indicted on one count of possessing a stole vehicle, a felony; one count of fleeing in a vehicle from an officer with reckless indifference to the safety of others, a felony; one count of fleeing in a vehicle from an officer while under the influence of a controlled substance, a felony; and one count of driving under the influence of a controlled substance, a misdemeanor. In another case, Arbogast was also indicted on one count of possession with intent to deliver methamphetamine, a felony.

-Matthew Gail Paugh, 36 of Elkins, was indicted on one count of fleeing in a vehicle from an officer with reckless indifference to the safety of others, a felony; and one count of fleeing in a vehicle from an officer while under the influence of a controlled substance, a felony.

-Christy Suzette Farrar, 44, of Buckhannon, was indicted on two counts of shoplifting, third or subsequent offense, a felony, and one count of escape or attempted escape, a felony.

-Mark Christopher Heater, 48, of Buckhannon, was indicted on one count of destruction of property, a misdemeanor, and two counts of failure to update sex offender registry, a felony.

-Kenneth Steven Shipman, 47, of Buckhannon, was indicted on one count of driving while license revoked for DUI, third offense, a felony.

-Patrick Bryan Stafford, 36, of Buckhannon, was indicted on one count of possession of firearm by a prohibited person, a felony.

-David Jay Lipps, 29, of French Creek, was indicted on one count of burglary, a felony, and one count of grand larceny, a feloy.

-Carl Dale Shobe, 35, of Elkins, was indicted on two counts of shoplifting, third or subsequent offense, a felony.

-Violet Marie Collins, 46, of Philippi, was indicted on one count of shoplifting, third or subsequent offense, a felony.

-Howard Allen Rakes, 46, of Buckhannon, was indicted on three counts of child neglect creating a substantial risk of death or serious bodily injury, a felony.

-Samantha Dawn Rakes, 36, of Buckhannon, was indicted on three counts of child neglect creating a substantial risk of death or serious bodily injury, a felony.

-Jesse Barnett, 76, of Buckhannon, was indicted on one count of fraudulent scheme, a felony.

-Robert Edward Sprouse, 31, of French Creek, was indicted on one count of grand larceny, a felony.

-Roger Gooden, 32, of Tallmansville, was indicted on one count of burglary, a felony.

-Jacob Nottingham, 28, of Buckhannon, was indicted on two county of burglary, a felony.

-Jeremy Allen White, 33, of Fairmont, was indicted on three counts of fraudulent use of an access device, a felony.

-Caleb Ryan Corder, 20, of French Creek, was indicted on one count of forgery, a felony, and one count of uttering, a felony.

Corder was also indicted on one count of fraudulent scheme, a felony; one count of embezzlement, a felony; and four counts of using a credit card without authority, a misdemeanor.

-Dale Wayne DeBarr, 44, of Buckhannon, was indicted on one count of failure to update sex offense registry, life registrant, a felony.

-Sydney Marie Williams, 22, of Buckhannon, was indicted on one count of conspiracy, a felony, and one count of fraudulent scheme, a felony.

-Carly S. Arbogast, 22, of Buckhannon, was indicted on one count of conspiracy, a felony, and one count of fraudulent scheme, a felony.

-Johnna Dee Courtney, 37, of Buckhannon, was indicted on one count of conspiracy, a felony, and one count of fraudulent scheme, a felony.

-Tyler Lynn Wolford, 26, of Buckhannon, was indicted on one count of failure to update sex offender registry, life registrant, a felony.

-Joshua Lee Cole, 28, of Walkersville, W.Va., was indicted on two counts of sexual abuse in the first degree, a felony; one count of sexual assault in the first degree, a felony; and one count of sexual abuse of a child by a parent, guardian or person in position of trust, a felony.

-William David Brown, 44, of Buckhannon, was indicted on three counts of incest, a felony, and 12 counts of sexual abuse of a child by a parent, guardian or person in position of trust, a felony.

-Alayna N. Puglia, 23, of Erial, N.J., was indicted on one count of conspiracy, a felony.

-Michaelina F. Sarne, 42, of Sicklerville, N.J., was indicted on one count of conspiracy, a felony; one count of kidnapping, a felony; and one count of first-degree robbery, a felony.

-Lamere S. Troup, 25, of Camden, N.J. was indicted on one count of conspiracy, a felony; one count of kidnapping, a felony; one count of first-degree robbery, a felony; and one count of malicious assault, a felony.

-Takiese Naceer Bethea, 23, of Camden, N.J., was indicted on one count of conspiracy, a felony; one count of kidnapping, a felony; one count of first-degree robbery, a felony; and one count of malicious assault, a felony.

-Christine Sunshine Casada, 39, of Buckhannon, was indicted on one count of possession with intent to deliver methamphetamine, a felony, and one count of conspiracy to possess with intent to deliver methamphetamine, a felony.

-Christopher Allen Schwable, 48, of Buckhannon, was indicted on three counts of sexual abuse of a child by a parent, guardian or person in position of trust, a felony.

-Joseph Kenneth Schwable, 52, of Buckhannon, was indicted on two counts of sexual abuse of a child by a parent, guardian or person in a position of trust, a felony.

-David Edwin Posey, 42, of Buckhannon, was indicted on one count of fleeing in a vehicle from an officer with reckless indifference to the safety of others, a felony, and one count of driving while license revoked for DUI, third or subsequent offense, a felony.

-John Osler Darnell III, 28, of Volga, was indicted on one count of possession with intent to deliver methamphetamine, a felony; one count of conspiracy to possess with intent to deliver methamphetamine, felony; one count of possession with intent to deliver marijuana, a felony; and one count of conspiracy to possess with intent to deliver marijuana, felony.

-Marcus Anthony Harrison, 23, of French Creek, was indicted on one count of possession of a stolen vehicle, one count; one count of fleeing in a vehicle from an officer with reckless indifference to the safety of others, a felony; one count of fleeing from an officer by means other than a vehicle, a misdemeanor; and one count of escape from custody, a felony. Harrison was also indicted on one count of grand larceny, a felony, and one count of conspiracy, a felony.

-Michela Destiny Long, 20, of French Creek, was indicted on one count of grand larceny, a felony. Long was also indicted on one count of conspiracy, a felony, and one count of offenses related to adults in custody, a felony.

-Daniel L. Carter, 37, of Clarksburg, was indicted on one count of driving under the influence of controlled substance, third or subsequent offense, a felony.

-Joshua Lynn Hinchman, 22, of Elkins, was indicted on one count of breaking and entering, a felony; one count of grand larceny, a felony; and one count of transferring stolen property, a felony.

-Michael J. Gregory, 54, of Buckhannon, was indicted on one count of fleeing in a vehicle from an officer with reckless indifference to the safety of others, a felony; one count of fleeing in a vehicle from an officer while under the influence of a controlled substance, a felony; one count of obstructing a law enforcement officer, a misdemeanor; one count of unlawful wounding of a police officer, a felony; and one count of escape from custody, a felony.

-Nathaniel Gage Confere, 20, of Buckhannon, was indicted on one count of possession with intent to deliver marijuana, a felony.

-Katrina Louise Stalnaker, 35, of Buckhannnon, was indicted on one count of possession with intent to deliver methamphetamine, a felony.

-Gary Lee Nelson Jr. 40, of Roanoke, W.Va., was indicted on one count of domestic assault, third or subsequent offense, a felony.
